This privacy policy provides you with all the necessary information on how, to what extent and for what purpose Nemesis Legal (thereinafter ‘Nemesis Legal’ or ‘we’) processes personal data. We are in the process of the registration of our legal entity as Nemesis Legal GmbH.

We collect contact data (including e-mail addresses) in order to provide our services to you as well as to inform you about product updates and product releases. We collect information about your device (such as type and version of your browser and operating system, type and model of your device, and unique identifiers about your device). We may associate your identifiers with your other information that we have collected. We also collect log information. When you use our platform service, we automatically collect and store certain information in server logs such include the IP-addresses. We use your IP address and the other log information for statistical purposes to improve our products and websites.

Our legal basis for collecting and using the personal data described in this privacy policy depends on the personal data we collect and the specific purposes for which we collect it.

  • we may use personal data you provide to personalize our products or services for you;

Legitimate Interests: We may rely on legitimate interests

  • to maintain and improve our services;

    • to provide services you have requested, and respond to any comments or complaints you may send us;

    • to monitor the use of our products and services, and may use your personal data to help us monitor, improve and protect our products, content, services and websites;

    • to personalize our products or services for you and to develop new services.

  • For compliance with applicable laws and protection of our legitimate business interests and legal rights, including, but not limited to, use in connection with legal claims, compliance, regulatory, investigative purposes (including disclosure of such information in connection with legal process or litigation). 

 

3. Who will we share your data with? Where is the personal data transferred?

To provide our platform service we may share your personal data with third-party providers. When we share these personal data, we make sure that appropriate safeguards are taken to protect your personal data. If personal data is transferred to a jurisdiction that is not covered by the adequacy decision of the European Commission, we transfer the data on the basis of standard contractual clauses. Prior to every transfer outside of Switzerland, we conduct an impact assessment of such data transfer.

In order to prevent unauthorized access or disclosure, we have put into place technical and organisational measures to safeguard and secure the information we process from you. We ensure a high level of security for confidential data,. However, we would like to take this opportunity to point out the general dangers of Internet use over which we have no control. 5. How long do we store your data?

We retain information about you only for as long as we need it for the purposes for which it was collected. After that time your personal data will be erased (unless we have the statutory right or obligation to further keep this data). You can obtain information free of charge at any time about the personal data we have stored about you and about the origin, recipient and purpose of data collection and data processing. You also have the right to demand the correction, blocking or deletion of your data. Excluded from this is data that is kept due to legal regulations or is required for proper business processing. If data is not covered by a legal archiving obligation, we will delete your data upon your request. Terms and Conditions Nemesis Legal

  • Definitions

User, End-User means You as a service user.

“Nemesis” or “We” means Nemesis Legal GmbH (legal entity in creation)

“Service” means the legal assistance provided as an interactive chat. 

 

  • Scope of Application

 

These Terms and Conditions (the "Terms") govern the use of the Nemesis AI Service (the "Service") provided by Nemesis Legal GmbH ("we", "us", or "our"). The Service is accessible via www.nemesis.legal and is offered to registered users ("User", "you").

 

The Terms apply to all users of the Service. By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the Service or use any services.

By accessing or using , you agree to comply with and be bound by these Terms and Conditions.

 

  • Description of Service

Nemesis  provides a research tool based on AI that allows semantic search within a legal database. The service may include, but is not limited to, output, features and functionality. The legal database is continuously growing. If you want more information about the current database, please reach out to us.

All services are offered as a cloud solution. Currently, we offer the software solution in a data center operated by Nemesis. The service allows customers and any beneficiaries to use the software product stored and running on the corresponding servers via an internet connection for the duration of the individual contract concluded under these Terms and Conditions for their own purposes and to process and store their data using the software products.

  • User Registration

To access certain features of the service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

  • Use of the Service

You agree to use the service in accordance with all applicable laws and regulations. You may not use the service for any illegal or unauthorized purpose.

  • Intellectual Property

As between you and Nemesis, and to the extent permitted by law, you retain the ownership rights in Input and Output.

  • Privacy Policy

Your use of the service is also governed by our Privacy Policy. By using the service, you consent to the terms of the Privacy Policy. Both parties comply with the applicable data protection laws.

By entering personal data of individuals other than You, You become the data controller of such personal data. By entering such personal data into the system of Nemesis AI, we process such personal data as a data processor. By entering personal data of third parties, you acknowledge that you have the right to process such personal data. If a User violates the applicable data protection laws, the User owes Us a contractual penalty of CHF 50’000.

  • Disclaimer of Warranties

The service is provided "as is" and "as available" without any warranties, either expressed or implied. Nemesis does not warrant that the service will be uninterrupted or error-free. Nemesis does not warrant that the results of Nemesis AI, its created content are correct.

  • Limitation of Liability

We do not guarantee the quality of the research performed by Nemesis AI. To the extent liability can be contractually excluded, Nemesis Legal excludes any liability in connection with the software service. Nemesis shall not be liable for any direct, nor indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. We assure that the use of the software does not infringe any third-party rights.

  • Availability of Nemesis Legal and Service Levels

 

Nemesis AI is available to paying users around the clock. It may happen that the software is not available for short periods. If this is longer than 1 day, the user can request that their subscription time be extended by the corresponding period.

  • Termination

We reserve the right to terminate or suspend your account and access to the service at its sole discretion, without notice, for any reason.

You have the right to terminate the contract by ending the subscription term.

  • Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Switzerland, excluding the conflict of laws provisions and the United Nations Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes is Zurich.

  •  Changes to Terms

We reserve the right to change or modify these Terms at any time and in our sole discretion. If we make changes to these Terms, we will provide notice of such changes, such as by sending an email notification, providing notice through the Service, or updating the "Last Updated" date at the top of these Terms. Your continued use of the Service will confirm your acceptance of the revised Terms. We encourage you to frequently review the Terms to ensure you understand the terms and conditions that apply to your use of the Service.
